(CNN) — Voting on strictly partisan lines, a House committee recommended Wednesday that Attorney General Eric Holder be cited for contempt of Congress for failing to turn over documents relating to the botched Fast and Furious weapons sting operation.
The measure now goes to the full House for consideration, expected next week, of what would be an unprecedented event — Congress holding a sitting attorney general in contempt.

WASHINGTON, DC — House Speaker John Boehner (R-OH) and Majority Leader Eric Cantor (R-VA) issued the following statement after the House Oversight & Government Reform Committee approved a resolution holding Attorney General Eric Holder in contempt for his refusal to turn over subpoenaed documents related to the Fast & Furious operation:
“Despite being given multiple opportunities to provide the documents necessary for Congress’ investigation into Fast and Furious, Attorney General Holder continues to stonewall. Today, the Administration took the extraordinary step of exerting executive privilege over documents that the Attorney General had already agreed to provide to Congress. Fast and Furious was a reckless operation that led to the death of an American border agent, and the American people deserve to know the facts to ensure that nothing like this ever happens again. While we had hoped it would not come to this, unless the Attorney General reevaluates his choice and supplies the promised documents, the House will vote to hold him in contempt next week. If, however, Attorney General Holder produces these documents prior to the scheduled vote, we will give the Oversight Committee an opportunity to review in hopes of resolving this issue.”

WASHINGTON — House Minority Leader Nancy Pelosi (D-Calif.) said Wednesday that the House Oversight and Government Reform Committee is playing politics with its vote to hold Attorney General Eric Holder in contempt of Congress, an action she said that even she didn’t seek as House Speaker when she thought someone was legitimately deserving of it.
“I could have arrested Karl Rove on any given day,” Pelosi said to laughter, during a sit-down with reporters. “I’m not kidding. There’s a prison here in the Capitol. . . If we had spotted him in the Capitol, we could have arrested him.”
Rove was senior advisor and deputy chief of staff to former President George W. Bush from 2001 to 2007.
Asked on what grounds she could have arrested Rove, Pelosi replied, “Oh, any number. But there were some specific ones for his being in contempt of Congress. But we didn’t.”

First, they want to see us talking and working together to get some jobs, get this economy back where it should be. But the whole idea that the Attorney General is targeted so that the president has to come and protect not him but to protect the Constitution is purely political.

(POLITICO) — In the aftermath of a Wednesday vote by a House committee accusing Attorney General Eric Holder of being in contempt of Congress, the attorney general accused the panel’s top Republican Rep. Darrell Issa (R-Calif.) of provoking a partisan showdown between the branches of government.
“He has chosen to use his authority to take an extraordinary, unprecedented and entirely unnecessary action, intended to provoke an avoidable conflict between Congress and the Executive Branch,” Holder said in a statement.
“This divisive action does not help us fix the problems that led to this operation or previous ones and it does nothing to make any of our law enforcement agents safer. It’s an election-year tactic intended to distract attention — and, as a result — has deflected critical resources from fulfilling what remains my top priority at the Department of Justice: Protecting the American people,” Holder said.
The conflict between Issa and Holder stems from a Mexican gun running operation nicknamed “Fast and Furious.” Earlier in the day, the Obama administration invoked executive privilege to avoid turning over a number of internal administration documents.
Holder said in a statement that the Department of Justice had already given the House Oversight and Government Reform committee ample cooperation in their investigation.”
“In recent months, the Justice Department has made unprecedented accommodations to respond to information requests by Chairman Issa about misguided law enforcement tactics that began in the previous administration and allowed illegal guns to be taken into Mexico,” Holder said.
“Simply put, any claims that the Justice Department has been unresponsive to requests for information are untrue. From the beginning, Chairman Issa and certain members of the Committee have made unsubstantiated allegations first, then scrambled for facts to try to justify them later. That might make for good political theater, but it does little to uncover the truth or address the problems associated with this operation and prior ones dating back to the previous administration,” Holder said.

The family of slain U.S. Border Patrol agent Brian Terry, who was killed with guns tied to the Fast and Furious program, issued a statement Wednesday afternoon accusing President Obama of compounding their family tragedy by invoking executive privilege.
President Obama invoked executive privilege to shield the Justice Department from having to release documents sought by House Republican investigating the secret law enforcement program, wherein weapons smugglers were permitted to buy guns so law enforcement could trace them to drug cartels. Law enforcement lost track of hundreds of the guns, which began showing up at crime scenes, most tragically in December 2010, where Terry was killed.
Terry family attorney Pat McGroder on Wednesday released the following statement from Terry’s parents Josephine Terry and Kent Terry Sr.: “Attorney General Eric Holder’s refusal to fully disclose the documents associated with Operation Fast and Furious and President Obama’s assertion of executive privilege serves to compound this tragedy. It denies the Terry family and the American people the truth.”
The Terrys said that their son “was killed by members of a Mexican drug cartel armed with weapons from this failed Justice Department gun trafficking investigation. For more than 18 months we have been asking our federal government for justice and accountability. The documents sought by the House Oversight Committee and associated with Operation Fast and Furious should be produced and turned over to the committee. Our son lost his life protecting this nation, and it is very disappointing that we are now faced with an administration that seems more concerned with protecting themselves rather than revealing the truth behind Operation Fast and Furious.”

Vice President Joe Biden called California governor Jerry Brown “the smartest guy in American politics” last night at a California fundraiser. Via the pool report:
Pool was ushered into the hall about 3:17 p.m., just in time to hear Gov. Jerry Brown at the podium ahead of Biden. Biden started speaking about three minutes later to a crowd of about 130 people.
“Nothing has changed,” Biden said of Brown, who was governor before from 1975 to 1983. Biden said he met Brown in San Francisco in the 1970s. He said, “He was the smartest guy in American politics then. He’s still the smartest guy in American politics.”

I don’t really care what your position is on the Great Michigan Vagina Debate, America. We disagree on the rules of decorum, I’m sure, and on our own independent analysis of the problem at hand and whether or not, exactly, Michigan is attempting to, in fact, legislate anyone’s vagina. I maintain that, in the name of scientific accuracy, they are, in fact, not attempting to legislate anyone’s vagina. If anything, they are legislating uteruses. Or uterii. Or whatever.
But let’s get one thing straight. Although I have no objection to saying the word, vagina, I do have an objection to knowing about yours. And frankly, I would assume that, in the immortal words of a former Michigan legislator, no one currently or formerly in the Michigan legislature has ever given a single thought to any of these womens’ actual vaginas.
And the protest yesterday only served to reiterate that point.

Mark Levin: Executive Privilege and how the House should move forward legally
Right from Mark Levin:
As the Supreme Court recognized in US v. Nixon, the Executive Branch has a legitimate interest in confidentiality of communications among high officials so that the President can have the benefit of candid advice. However, as President Washington himself recognized, that privilege does not protect the President or his underlings from embarrassment or public exposure for questionable actions.
As the Supreme Court has also recognized repeatedly, the Congress, in the exercise of its constitutional powers, has the essential power to investigate the actions of the Executive Branch.
In this case, the exercise of Executive Privilege seems, in its timing and over-inclusiveness, to be nothing less than a political delaying tactic to prevent exposure of wrongdoing and incompetence that resulted in the murder of a American law enforcement agent and injury and death of many others. Further, a wholesale claim of privilege is facially improper: the President should be held to the standard that anyone claiming privilege is held to: identify each document in a log so that privilege can be disputed. (U.S. v. Nixon, 1974)
Because among the categories of documents sought are all those relating to the recantation by Holder of testimony before Congress, the demand goes to the core of the Congressional power under Article I. In this respect, this is not a general or oversight inquiry but a determination of why the Attorney General of the United States testified falsely before Congress about his own knowledge of a federal program. Presumptively, none of this category of documents is protected by Executive Privilege for wrongdoing per se is not protected by the privilege.
The right way to proceed is to hold Holder in contempt by resolution of the House and seek authorization from the House for the Committee, by its Chairman, to proceed by civil action to compel production of the documents. (Holder will not enforce a holding of contempt against himself — and by the way, he should have authorized, say, the assistant attorney general for legal counsel, to handle the contempt matter once the House voted as at that point he is representing his own interests and not those of the nation generally). Chairman Issa should file suit in federal court in DC and seek expedited action. There is no need for Senate action. The use of this procedure has been acknowledged by the Congressional Research Service in a 2007 study. Further, a privilege log should be sought by Issa and ordered produced immediately by the court, in camera inspection done promptly by the judge, and a final order entered compelling production of all documents for which no legitimate reason justifies Executive Privilege.
Yes, some documents may be covered by EP, but the blanket attachment of that label flouts the law and the Constitution, and harms the legitimate assertion of EP by Presidents of either party in the future. The Constitution is far too important to be subject to the caprice of this President and an AG who, on its face, wants to be free from scrutiny about why he testified falsely before a Committee of Congress.
Executive Privilege is a very important implied executive power, used in various forms since the presidency of George Washington. Therefore, it’s misuse and abuse, to cover-up wrongdoing, conceal embarrassing information, or advance a political agenda, diminishes the ability of future presidents to assert it legitimately.

(Reuters) – The instructor of a college course that taught top military officers the United States was at war with Islam has been relieved of teaching duties and the course ordered redesigned to reflect U.S. policy, a military spokesman said on Wednesday.
The elective course at the National Defense University’s Joint Forces Staff College included a slide that asserted “the United States is at war with Islam and we ought to just recognize that we are war with Islam,” Pentagon officials said in April as they launched a review of the course.
Colonel David Lapan, a spokesman for the chairman of the Joint Chiefs of Staff, said on Wednesday a review of the course found that “institutional failures and in oversight and judgment” led to the course being modified over time in a way “that portrayed Islam almost entirely in a negative way.”
“The inquiry recommends the course be redesigned to include aspects of U.S. policy and reduce its reliance on external instruction,” Lapan said in a statement. It also recommended improving oversight of course curricula.
“The elective course’s military instructor has been relieved of his instructor duties until his permanent change of station, which was previously planned for 2012,” Lapan said.

Actress Olivia Wilde admitted to having a few things in common with Mitt Romney on Tuesday night, but was very clear that she is no fan, prominently wearing a “Dogs against Romney” pin during an appearance on “The Colbert Report.”
“I’m wearing my ‘Dogs against Romney’ pin,” she said, holding it up for the audience.
The pin refers to an anti-Romney campaign more heavily publicized earlier this year. Several groups, including animal-rights groups ASPCA and PETA, protested a story from 1983 about a 12-hour Romney family road-trip when the family dog, Seamus, was strapped in a kennel to the roof of the car. The Romneys have defended the decision, but animal lovers are less convinced.
“It’s just not right. It’s not right,” Wilde said.
Wilde, best known for the TV show “House” and movies such as “Cowboys & Aliens,” plans to campaign for President Obama, as she did in 2008. She said she would not characterize herself as “disappointed” in Obama, but added that the top three things she wants to hear the president address are drones in Pakistan, drug policy and Guantanamo.

The University of Minnesota – Duluth (UMD) is now sponsoring an ad-campaign designed to achieve “racial justice” by raising awareness of “white privilege.”
The project disseminates its message, that “society was setup for us [whites]” and as such is “unfair,” through an aggressive campaign of online videos, billboards, and lectures. The ads feature a number of Caucasians confessing their guilt for the supposed “privilege” that comes along with their fair features.
The self-titled Un-Fair Campaign, is sponsored and supported by the University of Minnesota – Duluth, along with several liberal organizations including the NAACP, YWCA, and The League of Woman Voters.
“You give me better jobs, better pay, better treatment, and a better chance — all because of the color of my skin,” reads one poster that features a close shot of a Caucasian male.

The U.S. military is guilty of political correctness toward domestic Islamic terror, according to a congressional report made public Wednesday that concludes al Qaeda is using U.S.-based Muslim radicals to plan mass casualty attacks.
“Homegrown radicalization is now the vanguard of al Qaeda’s strategy to continue attacking the United States and its allies,” said the report on domestic extremism by the House Homeland Security Committee. The report was based on several hearings held by Committee Chairman Rep. Peter T. King, New York Republican.
The report said evidence of the threat comes from recordings made public in Pakistan by the core al Qaeda terrorist group, as well from an English-language magazine produced in Yemen by two American jihadists. Additional evidence came from an American suicide bomber in Somalia who urged Muslims to wage “jihad in America.”
The report said violent Islamist extremism is “the No. 1 terrorist threat to this nation.”
Of particular concern, according to the report, is the threat posed by radical Muslims to U.S. military communities. The terror threat to military communities is “severe” and growing. It includes the use of “insiders,” like Maj. Niidal Hassan, the terrorist who carried out the 2009 Fort Hood shooting attack that killed 13 people and wounded 29 others.
The report faulted the U.S. military for “political correctness” toward Islam, which the report called a “potentially devastating development” for the security of troops and their families.
The Obama administration “chose political correctness over accurately labeling and identifying certain terrorist attacks appropriately, thereby denying Purple Heart medals to killed and wounded troops in domestic terror attacks,” the report said.
