Ghosts, Vampires, and $5 Million Gas? Ridiculous Lawsuits Abound

In advance of the U.S. Chamber Institute for Legal Reform’s annual summit, we’re taking a look back at some of the most ridiculous lawsuits of the year.

Haunted by Frivolity
It’s that time of year. The leaves are falling, nights are getting cooler, ghosts are forcing tenants out of rental agreements. A Toms River, NJ couple claims their rental house is haunted, and they’re suing their landlord for the security deposit. The landlord thinks that the couple was spooked by the rental fee and an other-worldly desire to break their lease.

The Price of Gas Really Is Skyrocketing!
Victoria Jean Church-Dellinger of White Lake, MI defaulted on lease payments for her 2008 Pontiac G6. The lender then repossessed her car. Simple enough? Not quite. The car still had half a tank of gas in it and her lost personal property—eight gallons of gas—is part of a class action lawsuit for $5 million. That’s quite a bit pricier than today’s $3.73 a gallon average.

From the Baseball Diamond, a Real Gem
Two years ago, eleven-year-old catcher Matthew Migliaccio’s errant throw teed off a spectator who was struck in the head. Elizabeth Lloyd, who said she was not hurt when asked, threw the Little Leaguer a real curveball when she sued him for more than $150,000 in damages and an undefined amount in pain and suffering. The swing-for-the-fences suit hasn’t been resolved.

“No I Have Not Forgotten About Stacy Dash!”

Such a statement is blasphemy to the slaves still on the Democrat plantation.

Yeah, Yeah, Yeah. I know pretty much everybody is focused on the debates. And I’ve had to put other things on the back burner to keep with the buzz.
But the water on the back burner is evaporating and I need to bring it to front and refresh it.

So I gotta take a break from debate talk and address other stuff that’s over due, in this case Stacy Dash, and my visit on Don’t Sleep!

During the course of show Marc Lamont Hill accuses conservatives like me of being a republican, because the line is shorter to the spot light.
I didn’t address this in my commentary because it would have gotten too long.

But I’d like to point out that this is a prime example of liberal narcissism.
Liberals tend to be so full of themselves that if you disagree with them, you must have a shady motive for doing so.
You can’t genuinely believe what you believe. It must be fake.
No real person could actually disagree with a liberal.
Liberals can’t handle losing. They’re so great in their view, that they can’t lose.
If they do it’s because the other guy cheated.
This is the ego and conceit of liberals.

So to Marc Lamont I’m some fake who claims to be a republican just because I want to be on T.V.
Maybe I’m hallucinating, but there seems to be a lot more blacks on T.V. that vote democrat than republican, and shorter line to the spotlight or not, it looks quite evident that the sure way to get into the entertainment industry is wear the liberal hat.

And that’s not just what it looks like. That’s how it is.

Marc Lamont thinks that I’m not genuine and thinks that I pull my ideas out of my a**,
but Marc Lamont would fail an emissions test with all the smoke that comes out his tail pipe.

Marc Lamont thinks I just want be on T.V. Yet has no evidence to back that up.

The 1st time I met Marc Lamont was on Red Eye. That was two years ago.
If I was so itchy to jump in this short line to T.V. time, you’d think I would have been on Red Eye a hundred times in the last two years, but I’ve only gone on the show a total of one time.

Marc Lamont goes on there a lot though.

Even when the producers of BET invited me on the show, my response was, “I’m kinda busy.”
(But I am grateful for them inviting me!)

I’ve been encouraged by Greg to come on Red Eye whenever I want. My job will fly me out there whenever I wanna go.
If I wanted to be on T.V. So flippin’ bad, I would be lookin’ to flash my mug on FOX News all the time as I have a welcome card to do so.

So Marc Lamont doesn’t know what the corn he’s talking about, and fo’ sho’ doesn’t know me, and the one who sounds crazy and full of himself to boot, is him.

Marc Lamont seems to like to get a lot of attention for patronizing blacks, making them out to be victims, and making excuses by giving the white man all this boogie man power, while being a tooter for the democrat party

But I’m the crazy one who just wants attention because I ain’t afraid of the white boogie man and don’t use him as an excuse there fore giving him arbitrary power over me and because I oppose the democrat party?

The party that wanted to force institutionalized slavery when republicans wanted slavery abolished.

The democrats that founded the KKK, imposed, Jim Crow, Dred Scott, revoked 40 Acres and a mule, eugenics, anti-miscegenation, opposed civil rights, and voter rights, etc. when republicans were fighting them on these things?

So hell no. I don’t vote democrat. But I’m the crazy one, while the majority of the black community is loyal to democrats, and hates republicans. Wow.

And don’t even start with the party switch thing. It’s bogas.

Don’t try to say that those racist southern states are republican red now, because you just shot down your own notion.

I say again. Yes, those states were hot with racism when they were controlled by democrats. Segregation, harassment, assaults, cross burnings, lynchings, and just flat out morbid bigotry.

But now that those states are republican red, you don’t really here about those things any more, do you?
That should speak volumes to liberals, but it goes right over their heads. They’re the ones still stuck in the past while calling themselves progressives.

The states have moved on to be republican leaning and are far less racist. If there was a switch, that was it.

It wasn’t racist democrats becoming racist republicans.

Urgent – Death Panels Here, Doctors Plea For Help

Doctors across America are sick. A new and desperate plight has surfaced in emergency rooms across the nation for both patients and doctors alike. The following blog by one valiant doctor speaks for thousands of doctors being forced to go against their natural instincts and abilities to allow further hospital care and re-admit patients.

Effective October 2012, doctors at hospitals across the land are being forced by the Obama administration to break their Hippocratic Oath. Obama’s revamped Medicare has now begun forcing doctors at hospitals to turn their backs on patients no matter how critical their need for re-admittance. Obamacare has activated a mandate through Medicare that will cost thousands of lives and serves as the precursor to Obama’s inhumane and authoritarian Death Panels.

The following excerpts are used with permission from the blog of Dr. Thomas Hamilton, an American doctor who speaks truth to power. Dr. Hamilton describes how he was torn between providing medical help to a very sick senior or turning her away to face a certain and tragic fate without treatment.

“It was my plan to admit this woman to the hospital. I found out a little later that this same woman had been a patient here just slightly more than 2 weeks ago with a DIFFERENT DIAGNOSIS. I was told that if this woman was admitted, the hospital would not be paid.

The new Medicare rule now is that if the same Medicare patient is re-admitted to the hospital within 30 days, the hospital will not be paid. When they first started this nonsense they said this only applied to patients with the same diagnosis. Now they have “expanded” the rule to include re-admissions for any reason. So if you’re in the hospital for pneumonia, and 3 weeks later, you break your leg…….too bad. Medicare will not pay the hospital to fix your leg.

A little later a man was brought in by ambulance, very sick, in pain, and near death. I did my usual evaluation and treatment, doing my best to ease pain and stabilize this man’s illness. He needed to be admitted. To my chagrin I found out that he had been treated for the SAME problem at a DIFFERENT HOSPITAL about 10 days prior. If I admitted this man, our hospital would be paid nothing. I admitted the man.

My friends I am caught in a terrible position. I could have given treatment to both of these people and sent them out. There is no doubt that both of them would have died. Oh, I could also be sued for malpractice, but nobody cares about that.

House Republicans say new U.S. Department of Agriculture (USDA) guidelines aimed at forcing students to eat fruits and vegetables are a failure because students across the country are simply tossing the healthy fare into the trash.

“[T]here remains great concern with the amount of food waste generated at school cafeterias, much of it brought on by requiring students to take fruits and vegetables rather than simply offer them,” Reps. John Kline (R-Minn.), Kristi Noem (R-S.D.) and Phil Roe (R-Tenn.) told USDA Secretary Tom Vilsack in a letter sent Thursday.

“This is a waste of federal, state and local funds and is contrary to the law’s goal of feeding as many low-income and hungry children as possible,” they said. “Once again, we are aware USDA has attempted to address this situation by allowing greater choice in reimbursable meals, but students should not have to take additional food if they have no intention of eating it.”

Republicans have been criticizing USDA school lunch guidelines for the last few months, in particular USDA rules that set maximum-calorie guidelines for all meals subsidized by taxpayers. Last month, Rep. Steve King (R-Iowa) introduced the No Hungry Kids Act, which would repeal these calorie restrictions.

Obama Campaign Co-Chair Eva Longoria Gets Schooled

Liberal celebrities want all of the adoration that social media engagement has to offer — but none of the accountability that actual engagement requires. For the Hollywood elite, it’s “do as they say, not as they tweet.” But actress and outspoken Obama campaign co-chair Eva Longoria learned a hard lesson this week on Twitter:

Conservatives online are mad as hell and aren’t taking it anymore.

On Tuesday night after the second presidential debate, Longoria shared a “retweet” from one of her 4.4-plus million followers on the micro-blogging network. “I have no idea why any woman/minority can vote for Romney,” the message read. “You have to be stupid to vote for such a racist/misogynistic tw*t.” (I’m editing the vulgarity for family newspapers, but the tweet’s foul reference to a woman’s reproductive organs was neither censored nor disavowed by Longoria on her Twitter timeline.)

On Wednesday morning, the editors at Twitchy.com, my Twitter curation/aggregation site, captured and saved Longoria’s retweet for posterity. Conservative minorities and women raised their voices. A representative sample:

Wrote Diana Yellow (@navajochic): “I don’t appreciate u call’n me stupid. Ur ignorant, selfish and stupid urself! I’m a Romney/Ryan voter, I’m female and a minority.”

Becky Gonzalez (@nanabec2) tweeted: “You can vote with your lady parts — I’ll vote with my lady smarts. VOTE ROMNEY!!!”

Melissa (@melissaDiva) responded: “So @EvaLongoria b/c I am a woman and support @MittRomney I am stupid? Your comment is disgusting and disrespectful to women. Shame on you.”

Mayelin de Villegas (@mayelinddv) informed the starlet: “I am Hispanic. I am very informed on all issues. Will be voting for Romney and proud to say it.”

After Twitchy.com called attention to the Obama campaign co-chair and “War on Women” propagandist’s backhanded swipe, she tried to cover her tracks by deleting the message. But Twitter and Twitchy are forever. On Thursday morning, the panicked actress launched into damage-control mode — and made matters even worse.

First, she claimed that “twitter (was) bugging out” and asserted that “there are things in my timeline I didn’t retweet today.” Longoria then absurdly assured followers that she was under the social media hood searching for an imaginary glitch: “Standby trying to fix!” The naked attempt to channel disgraced Democratic Rep. Anthony Weiner, who shamelessly blamed a nonexistent hacker for posting lewd photos of himself on Twitter, flopped among tech-savvy Twitter users.

“Blame it on A) The altitude B) The ‘video’ C) Hillary!” joked one reader.

“She inherited all her re-tweets from the previous twitter user,” jibed another.

“She has binders full of excuses,” chimed another.

Writer Derek Hunter mused: “(Y)ou’ve got to find it amusing how @evalongoria is ‘trying to fix’ her twitter like she’s writing code or something.”

Faced with an avalanche of mockery and disbelief, Longoria finally tossed aside her make-believe monkey wrench and ‘fessed up. Well, kinda sorta, in that classic crapweasel politican’s way. She tweeted that she was “(s)orry if people were offended by retweet” and that “I respect all Americans.”

“Sorry if.” Give her the award for Worst Performance by a Self-Destructing Celeb on Social Media. Longoria topped off her faux-pology by explaining that she was merely trying to create “dialogue” and then pivoted faster than an Olympic speed skater by protesting that we should all be talking about “real issues” such as “equal pay, the economy and our health care choices” instead of “tweets.”

Not so fast there, missy. You should know that Longoria is guilty of retweeting at least one other crude message bashing Republicans. Twitchy.com staff noted that on October 11, the night of the vice presidential debate, Longoria retweeted this appalling observation from soap opera star Nancy Lee Grahn: “Biden is making Paul Ryan his prison b****!” Longoria retweeted the offensive prison rape analogy without any censorship or disapproval whatsoever. And on the campaign trail, Longoria has expressed similar views disparaging conservative women. In Colorado this July, she asserted that “there is no way you can vote Republican” if you’re a woman.

The real issue with “dialogue”-seeking Longoria, who refused to answer any of my questions on Twitter, is that she is a phony spokeswoman for American women outside the Hollywood-D.C.-Manhattan bubble. She has unmistakable contempt for women who reject the Obama campaign’s radical “lady parts” identity politics.

It is not a waste of time to respond to Hollywood hatred of conservative women and minorities. It is a waste of the First Amendment to be silent.

Really? No Death Panels?

Whatever else you may want to say about him, economist Robert Reich is a man who tells it like it is — or as he would like it to be. The former Clinton administration Labor secretary gave a taped lecture at Berkeley University in 2007 explaining how the “honest” candidate for president would sell healthcare reform to the American people.

The candid candidate would tell Americans, Reich ventured, that healthcare reform will mean young people will pay more, the elderly will die sooner, and medical innovation will suffer. When it comes to seniors, Reich’s not-poll tested stump speech would go like this:

If you’re very old, we’re not going to give you all that technology and all those drugs for the last couple of years of your life to keep you maybe going for another couple of months. It’s too expensive. So we’re going to let you die.

They applauded in Berkeley — but advocates of healthcare reform were livid two years later when Sarah Palin offered an equally honest assessment of pending healthcare legislation, charging that it would introduce rationing and “Obama’s ‘death panel’” into American medicine.

The New York Times scoffed at the “death panel” claim, labeling it a “stubborn, but false rumor” and then-Newsweek editor Jon Meacham called it “a lie crafted to foment opposition to the president’s push for reform.”

Now we learn that buried deep within the healthcare law’s 2,801 pages of foggy prose is a provision to create a panel of bureaucrats with final authority on what treatments will and will not be paid for by Medicare, the federal insurance program that serves nearly 48 million seniors and disabled individuals. It’s called the Independent Payment Advisory Board (IPAB), a 15-member committee whose cost-cutting edicts are not subject to review by the courts or the people.

The health law gives this board of presidentially appointed and unaccountable “experts” the power to use price controls and other cuts to achieve spending reduction targets prescribed in the law. And there is very little Congress can do to stop the binding “recommendations” of this Independent Payment Advisory Board from taking effect. Its proposals are law unless Congress says “No,” which requires a majority House vote, an unlikely 60-vote Senate supermajority, and presidential approval.

Douglas Holtz-Eakin, a former director of the Congressional Budget Office, calls IPAB a “dramatic policy error” and “possibly the most dangerous aspect of the Patient Protection and Affordable Care Act.” The threat from IPAB, Holtz-Eakin points out, is that “It will effectively determine that patients should have coverage for one particular treatment option, but not another, or must pay much more for one of the treatment options.”

Rep. Phil Roe (R-TN) has practiced medicine for more than 30 years and calls IPAB the “real death panel.” His bill to repeal the healthcare cost-reduction board has won enough Republican and Democratic co-sponsors to pass the House. The Senate outcome is less certain.

From Big Hairy News -

Democrats Flocking To Gingrich

BIG HAIRY NEWS – Latest poll results show that Democrat voters are flocking to support Republican Newt Gingrich, after allegations by his angry ex-wife that he is an immoral sex addict and serial adulterer.

“All I know is I can really relate to this guy,” said longtime Democratic voter Kip Fresner. “I guess he shares my core values and also reminds me of Bill Clinton – I loved that guy.”

The Gingrich campaign was initially caught by surprise by the unexpected influx of support from Democrats, but are now releasing photos of the candidate with various anonymous women, and quietly planting stories on-line of Newt’s sleazy sexual encounters.

The Romney campaign is reportedly very concerned that Gingrich may also claim to be gay, thus capturing even more former Democrat voters.

###

As I watch the media circus surrounding Marianne Gingrich’s interview regarding her relationship with her ex-husband and GOP candidate, Newt Gingrich, I am once again reminded of the double standard afforded to the Democrats and Barack Obama in particular.  Coming on the heels of the Herman Cain melee in which the press had a field day parading one accuser after another before video cameras, it is difficult not to repeat the question of why the Democrats get a free pass.  Why are calls for Mitt Romney to release his tax return not met with calls for Barack Obama to release his college transcripts — something that is just as customary for presidential candidates?

However, of greater importance in my view is the silence, save for a few journalists and pundits on the right, regarding exposing a videotape recorded in 2003 of Barack Obama at the farewell dinner for terrorist-supporting Palestinian Rashid Khalidi.  News of the videotape’s existence came to light while Obama was a candidate, and the free pass given to him by the mainstream media was only just beginning to come to light when the enamored Chris Matthews’ shared news of the tingle up his leg.

While the birthers’ demands did draw some media attention, it was mostly negative and only made fun of the supposedly crazy loons on the far right who apparently were representative of all petty and irrational conservatives.  No one seemed to notice that Obama had not written a single article while serving as editor of The Harvard Law Review, and no one pressed the issue of Obama’s suppressed college and law school transcripts since it was a given that his brilliance was perhaps surpassed only by the likes of Albert Einstein.

But there is a videotape sitting in the vaults of the Los Angeles Times, and every American should be screaming from the rooftops for its release.  In light of the Arab Spring, Obama’s endless attempts to bully Israel into succumbing to all sorts of unprecedented and unsafe demands in the hopes that he would go down in history as the POTUS who made peace between the Israelis and Palestinians, and the administration’s ineptness in addressing Iran’s nuclear program and military threats, exposing this videotape is of utmost importance.

Work with Congress ‘when possible’ ???

White House Press Secretary Jay Carney said that President Obama would continue to roll out “We Can’t Wait” initiatives under his executive authority throughout 2012, but maintained that the president will “eagerly” work with Congress when possible.
“[Obama] has been talking about the fact that he will use his executive authority to advance the priorities of the American people, and he has been doing that,” Carney told reporters during today’s press briefing. “He will continue to do that. It is true that the context here is often, we can’t wait for Congress to act, and that will be true throughout the year.”
Obama has been criticized in the past for his apparent willingness, and sometimes desire, to circumvent Congress; his unprecedented reinterpretation of the conditions necessary to make recess appointments earlier this month was especially controversial.
Carney emphasized that Obama would like to work with Congress if Republicans wll stop blocking the stimulus program contained in the American Jobs Act. “Where Congress will act, he will eagerly join with them to get the people’s business done,” Carney said.

Via The Hill:
President Obama is acting like the Emperor from the “Star Wars” saga, stoking hatred and class warfare, Rep. Louie Gohmert (R-Texas) accused in an interview with the conservative news site Newsmax published Thursday.

“He is playing class warfare, and I have been really hurt for America as I’ve seen our president basically take a page out of the playbook of Darth Vader’s leader, the evil Emperor, when he was saying, ‘Yes, feel the hatred,’” Ghomert said in a phone interview published on the conservative site.

“This president says, ‘Look around, see things you want,’” continued the outspoken Republican congressman. “‘You ought to be jealous of what they have. Help us push legislation that takes their money away and gives it to you.’”

It takes a lot to get the Catholic Church fired up, but apparently Obama has succeeded at doing it.

WASHINGTON — The Catholic Bishops of the United States called “literally unconscionable” a decision by the Obama Administration to continue to demand that sterilization, abortifacients and contraception be included in virtually all health plans. Today’s announcement means that this mandate and its very narrow exemption will not change at all; instead there will only be a delay in enforcement against some employers.

“In effect, the president is saying we have a year to figure out how to violate our consciences,” said Cardinal-designate Timothy M. Dolan, archbishop of New York and president of the U.S. Conference of Catholic Bishops.

The cardinal-designate continued, “To force American citizens to choose between violating their consciences and forgoing their healthcare is literally unconscionable. It is as much an attack on access to health care as on religious freedom. Historically this represents a challenge and a compromise of our religious liberty.”

The HHS rule requires that sterilization and contraception — including controversial abortifacients — be included among “preventive services” coverage in almost every healthcare plan available to Americans. “The government should not force Americans to act as if pregnancy is a disease to be prevented at all costs,” added Cardinal-designate Dolan.

At issue, the U.S. bishops and other religious leaders insist, is the survival of a cornerstone constitutionally protected freedom that ensures respect for the conscience of Catholics and all other Americans.

“This is nothing less than a direct attack on religion and First Amendment rights,” said Franciscan Sister Jane Marie Klein, chairperson of the board at Franciscan Alliance, Inc., a system of 13 Catholic hospitals. “I have hundreds of employees who will be upset and confused by this edict. I cannot understand it at all.”

“The Obama administration has now drawn an unprecedented line in the sand,” he said. “The Catholic bishops are committed to working with our fellow Americans to reform the law and change this unjust regulation. We will continue to study all the implications of this troubling decision.”
